【《苛政猛於虎 不畏勇如犢》- 大專學界就六名立法會議員被無理禠奪議席之聲明 | “Fearless in Face of the Horrid Tyranny” - Declaration by Students’ Unions of Higher Institutions to the Loss of Seats of Six Legislative Councillors】

前任特首梁振英同律政司舊年入稟覆核劉小麗、羅冠聰、梁國雄同姚松炎嘅宣誓效力,想禠奪佢哋嘅議員資格。高等法院噚日宣判佢哋四個嘅宣誓無效,由舊年十月十二日起已經喪失議員資格,法庭同時頒下禁制令,即時禁止佢哋四個自稱立法會議員同埋繼續履行議員嘅職責,仲要支付政府同律政司嘅訴訟費。
赤色政權為咗打壓異己,禠奪青年新政梁頌恆、游蕙禎嘅議員資格之後,再急急腳重新解讀《基本法》第一百零四條,肆無忌憚咁樣去僭法,本身已經與司法獨立背道而馳;但中共同佢嘅附傭得逞後仲得寸進尺,再用司法手段暴力干預立法機關。港共頭目不惜挑戰立法會主席嘅憲制權力,入稟覆核四位議員已獲確認嘅宣誓,扭盡六壬誅鋤異己。共匪傲慢無道,一再殘民以逞,被禠奪嘅唔止喺六位議員嘅資格,更加喺背後十八萬選民與生俱來嘅公民權利。高院噚日頒下判詞,文中參考咗人大釋法結果,裁斷四位議員嘅宣誓「不真誠」、「不莊重」,再次揭示中共手握扭曲法律之大權,《基本法》嘅承諾只不過喺信口開河。
多年嚟,中共政權多次脩法害民。以往港人一直相信議會抗爭嘅成效,寄望議員能夠以拉布等方式拉倒惡法,成為港人嘅護盾。然而去到今日,我哋唔能夠對制度內嘅抗爭抱過高期望。舊年立法會選舉,先有梁天琦同陳浩天等人因政見而無法參選,再到今日總共六位議員因為喺宣誓當中表達自己嘅立場而遭剝奪資格,可見港共傀儡一定會千方百計將一切反對聲音拒諸制度之外。今日政府能以宣誓唔準確挑戰議員資格,他日亦能以其他藉口防民之口。我哋可以預見議會抗爭將漸趨沉寂。日後就算有非建制議員捲土重來,參與補選,亦必須時刻警覺,避免依賴喺制度入面嘅抗爭。面對強權接二連三嘅輾壓,港人已被趕進窮途末路,就算身陷絕境仍要自強不息,與同道並肩,砥鋒挺鍔,收復失地。

Last year,former Chief Executive Leung Chun Ying and Secretary for Justice applied for a case against legislative Councillors Lau Siu Lai, Law Kwun Chung, Leung Kwok Hung and Yiu Chung Yim on the validity of their ways of taking the oath, and that they should be disqualified from assuming their seats in the Legislative Council. The High Court yesterday ruled that the oaths they took were invalid, and thus, they could not assume their seats from 12 October. The ruling includes an injunction barring them from claiming to be or acting as Legislative Councillors, and they will have to pay for the court cost of the government and their own lawyers.
The odious government of communist China staggeringly re-interpreted Article 104 of the Basic Law after attempting to strip the then Legislative Councillors Leung Chung Hang and Yau Wai Ching of Youngspiration of their seats. Such deplorable attempt to twist our laws was already an insult to our independent judiciary, and yet, communist China and its puppet regime in Hong Kong went as far as intervening our legislature through judicial means. In order to suppress dissidents, the puppet regime exhausted all means and challenged the power of the President of the Legislative Council and filed a case against the four oaths that had been accepted by the President. We are again and again humiliated tormented by the arrogance of communist China. Our foes have deprived us of not just six representatives in the legislature, but also the civil rights of 180,000 of us. As stated in the ruling, it is based on a proper construction of the interpretation of the Basic Law, and thus, the four did not ‘sincerely believe in and strictly abide by the oath’. Once again, communist China is superior even to our laws, and the promise that Hong Kong has a high degree of autonomy in the Basic Law is nothing but a paradox.
Throughout the years, our laws have been interpreted at the will of the communist regime. In the past, Hong Kong people have been believing in the effectiveness of struggling against the evil regime through means like filibustering to protect us from vicious laws. Nevertheless, we must not place unrealistic expectations on struggles within the establishment. From the political screening of localists like Leung Tin Kei and Chan Ho Tin in the Legislative Council Election 2016 to the disqualification of six Legislative Councillors because they expressed their views through taking the oath, it can be a categorical statement that all opposing voices will eventually be expelled from the system. If today a seat in the Legislative Council can be challenged based on the ways of taking oath, then tomorrow seats can be stripped away based on any arbitrary reasons. The fig ht in the Legislative Council will eventually be in vain. While democracy supporters are now planning to earn the seats in by-election, they must bear in mind that they can never rely on struggling only within the legislature. Facing the perpetual oppression by the unmeasured menace of our enemy, while we are now being pushed into a dead end, we must strive as a unified community. As we arm ourselves with persistence and determination, we shall fight to the end and see our victory.
